The FinCEN RRE rule is currently paused, but public guidance is not uniform. Here’s a snapshot of what official sources are saying. For transaction-specific direction, check with your underwriter and legal counsel.
FinCEN says: “Reporting persons are not currently required to file real estate reports with FinCEN and are not subject to liability if they fail to do so while the order remains in force.”

ALTA says there is “considerable uncertainty” after the Texas ruling, says an appeal is likely, and says “the cautious approach is to continue collecting information as if you will need to report.” ALTA also says, “If the court’s ruling is stayed, the rule will be back in full effect.”

First American states: “A Federal Court has invalidated the law” and “At this time, we are no longer requesting that you provide information related to that law.” It also adds: “That decision is not final and may be set aside.”

Stewart states: “FRS will continue to collect all required FinCEN data at no charge” and “FRS will not submit any data to FinCEN until the rule is officially back in force, a stay is issued, or the rule is otherwise deemed in effect pending appeal.”

The public guidance varies because FinCEN says filing is not currently required while the court order remains in force, while ALTA and some underwriters are publicly addressing the possibility of an appeal or stay that could change the rule’s status again.
